By accessing or using the Foresera platform, including our website, tools, and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.
These terms apply to all visitors, users, and others who access or use our platform, whether through online tools, service agreements, or any other means of engagement.
2. Description of Services
Foresera is an automated accessibility compliance platform. Our services include:
- Web Accessibility Audits — Automated analysis of websites against WCAG 2.1 Level AA standards and ADA Title II requirements, producing detailed compliance reports with actionable remediation guidance.
- Document Compliance — PDF document remediation services that analyze and transform documents to meet accessibility standards, including proper tagging, reading order, and alternative text.
- Growth & Design Intelligence — Conversion analysis, design evaluation, and design-to-code generation capabilities currently in limited availability. Contact us for details on access.
Certain services, including custom engagements and full compliance projects, are subject to separate written agreements. These Terms govern general use of the website and online tools.
Enterprise customers: If you are subject to a Master Service Agreement with Foresera, that agreement and its exhibits (including any applicable Statement of Work, Service Level Agreement, and End User License Agreement) govern your use of the platform and supersede these Terms of Service to the extent of any conflict.
We may add, modify, or discontinue features at our discretion. We will make reasonable efforts to notify users of significant changes to services they actively use.
3. User Responsibilities
When using Foresera, you agree to the following:
- Accurate information — You will provide accurate and complete information when submitting forms, creating accounts, or interacting with our platform.
- Rights to submitted content — You have the legal right to submit any URLs, documents, or other content you provide to our platform for analysis. You will not submit content that you do not own or have authorization to share.
- No misuse of scanning tools — You agree not to misuse our scanning tools, including submitting URLs for websites you do not own or operate, or using automated means to overload the service.
- No malicious files — You will not upload files containing malware, viruses, or any code designed to damage, interfere with, or gain unauthorized access to systems or data.
- File size limits — Uploaded documents must not exceed 20MB per file. Files exceeding this limit will be rejected.
- Lawful use — You will use our services only for lawful purposes and in compliance with all applicable laws and regulations.
4. Important Disclaimer: Not Legal Advice
Foresera provides technical accessibility analysis. Our services do not constitute legal advice, legal counsel, or legal compliance certification. Foresera is not a law firm.
Our audit reports, remediation recommendations, and compliance assessments are based on automated technical analysis against published accessibility standards such as WCAG 2.1 and ADA Title II requirements. While we strive for accuracy and comprehensiveness, our results should not be interpreted as a guarantee of legal compliance.
Our services help organizations work toward WCAG 2.1 AA compliance but do not guarantee legal immunity from ADA or other accessibility-related claims. We strongly recommend that organizations consult with qualified legal professionals regarding their specific compliance obligations. Accessibility law varies by jurisdiction, and legal requirements may extend beyond the technical standards our platform evaluates.
Foresera is not responsible for any legal outcomes, claims, or proceedings that may arise in connection with the accessibility status of your digital properties, regardless of whether our services were used.
5. Intellectual Property
Foresera's Property
The Foresera platform, including its software, analysis engines, report formats, design systems, branding, and all related intellectual property, is owned by Foresera. You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of our platform without our express written permission.
Your Content
You retain full ownership of all content you submit to Foresera, including URLs, PDF documents, and any other materials. By submitting content, you grant Foresera a limited, non-exclusive license to process that content solely for the purpose of delivering the requested services.
6. Limitation of Liability
To the maximum extent permitted by applicable law, Foresera and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services.
This includes, without limitation, damages for loss of profits, data, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from these terms or your use of our services shall not exceed the amount you paid to Foresera in the twelve months preceding the claim.
Our services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the accuracy, completeness, reliability, or suitability of our analysis for any particular purpose.
7. Account Termination
We reserve the right to suspend or terminate your access to our services at any time, with or without notice, if we reasonably believe that you have violated these terms or are using our platform in a manner that could harm Foresera, other users, or third parties.
You may discontinue your use of our services at any time. If you wish to have your account and associated data deleted, please contact us and we will process your request in accordance with our Privacy Policy.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
Any disputes arising from or relating to these terms or your use of our services shall be resolved in the courts located in the State of Delaware, and you consent to the personal jurisdiction of those courts.
